Virginia Code §8.01-50 is Virginia’s Death by Wrongful Act statute, which provides a right to bring forth a lawsuit when a loved one suffers death because of negligence and carelessness of another person, corporation or other entity. While the law that applies to wrongful death and personal injury cases is similar in many regards, payment for the loss and harms suffered differs. In a personal injury case where the injured survives, that person receives compensation for his or her own pain, suffering, wage loss, and medical bills. In a wrongful death case, however, the injured person has passed and can no longer receive payment for that happened. Therefore, compensation goes to the surviving family members eligible to receive payment for their sorrow and loss of companionship and financial support they received from their lost loved one. A wrongful death action must be brought in the name of the personal representative of the deceased within a certain period of time—which is Virginia is typically within two years of the date of death.

Va. Code §8.01-52 of Virginia’s Death by Wrongful Act statute sets forth damages that can be recovered in the event of wrongful death. That statute also specifies that a judge or jury has the discretion to award damages in a manner they believe to be “fair and just.”
