Childhood Traumatic Brain Injury: A Virginia Beach/Norfolk, VA Children’s Personal Injury Lawyer’s Advice
In my 23 years I’ve represented many children and their families who’ve been seriously hurt in car wrecks. One of the most serious cases I have worked on in recent years was a little girl who was hit in her family car by a truck in Virginia Beach. The girl was in the vehicle with her mother and sister all of whom suffered serious injuries. The 3‑year‑old child was hurt the worst and suffered a traumatic brain injury (TBI).
In this particular child’s case there was clear bleeding inside the skull showing the brain injury. Often there isn’t any obvious bleeding that shows up on a CT or CAT scan in the emergency room after a car/truck wreck.
What happened in this case was that after her initial healing the infant was appearing mostly normal to her teachers and even her parents. However, the parents and the neurologist and neuropsychiatrist treating the girl were concerned about what would happen in the future. Normally until a child is about 6 or 7 it is extremely difficult to assess the effect of a brain injury on them. Until that time the child hasn’t developed their personality and brain capacity enough to be able to judge some of the effects of the post-concussion syndrome and traumatic brain injury.
Ultimately we were able to obtain a settlement against the insurance company for the at‑fault truck driver in the amount of $5.5 million. This sum assured the parents that their daughter would be protected even if the mother and father weren’t there to help her in later life. One of the key damages was the amount of money it would take in the future to provide the necessary care to make sure that the girl could compensate for her loss of executive function meaning good decision-making in later life. Often traumatic brain injuries cause people to be unable to function normally and hold down a job or even keep themselves safe at home because of the problems caused by a brain injury.
I worked together with a team of lawyers at my old law firm to obtain this result. You should note that not every case will come out equally successfully. The facts of each case as well as the medicine and the law may be different. However in order to obtain the best possible result it makes sense to hire a specialized Virginia personal injury attorney with experience in traumatic brain injury if you or your kids are hurt in a way involving TBI.
