Norfolk Medical Malpractice Attorney Report-Delayed Lung Cancer Diagnosis leads to 27-year-old’s death
I found this article in the July 2 issue of the Virginia Lawyer’s Weekly. The case involved a victim who unfortunately died as a result of an incorrect initial diagnosis. He was first diagnosed with a sore throat/pneumonia when in fact it was cancer.
A chest X-ray performed in September 2006 revealed that the victim had a mass in his left lung that was not reported by the ER physician to the reviewing radiologist. The reviewing radiologist found the discrepancy but failed to notify the ER physician neither by telephone nor in a face-to-face conversation regarding the findings. The radiologist instead chose to report the discrepancy through the hospital’s computer system and delivering a discrepancy from the ER physician. The form never reached the physician and the victim was incorrectly treated with Zithromax for a misdiagnosed sore throat and/or bacterial pneumonia.
In June 2008, the victim returned to the hospital due to severe shortness of breath and chest pain. The chest X-ray revealed a mass in the left lung and fluid was extracted which tested positive for cancer. Unfortunately for the victim, the cancer had metastasized to the brain. After intensive treatment of chemotherapy, radiation, and gamma knife surgery, the patient died in September 2009.
The plaintiff’s expert witnesses were prepared to testify that the cancer had progressed from a curable Stage I or Stage IIA cancer to an incurable Stage IV during the 16 months between the misdiagnosis and the correct one.
