Man Blinded in Richmond, VA Organ Cleaning Accident is Awarded $750,000
When accidents take place in a building the owner of the premises may be held liable for an unsafe condition. As a Virginia Beach injury lawyer, I have reported on a number of premises liability cases ranging from customers slipping on the floors of supermarkets to objects falling from building sites.
In a recent case in Richmond a jury awarded $750,000 to a man who was injured while he was repairing a pipe organ at Richmond’s Byrd Theatre.
A circuit court jury sided with the plaintiff at the end of a four-day trial, the Richmond Times-Dispatch reported.
He had sued the Byrd Theatre Foundation after an accident in May 2009 left him blind in his right eye. The plaintiff’s lawyers argued he fell and hit his head when the plank he was standing on as he repaired and cleaned the organ, collapsed.
Lynne Jones Blain, an attorney for the foundation, maintained it was not at fault, the Richmond Times-Dispatch reported.
Accidents like this one may seem unusual but when they occur someone is often at fault. Earlier this year a settlement was made to one of my clients who was member of the Right on Band, after stage equipment fell on his head in Virginia Beach.
