Have You Ever Handled a Case That was Impacted by the Statute of Limitations?

We try our very best at Cooper Hurley Injury Lawyers to not to ever get close to the statute of limitations because it can present such a challenge if there’s an error made. So with my cases, I try to be proactive, and that means months before this the statute of limitations is approaching, if we haven’t resolved a claim, we go ahead and file a lawsuit. And that allows us to make sure that we are being proactive in our litigation and that we’re able– should there be some error, let’s say that the police report incorrectly names the defendant or spells the defendant’s name wrong– we have time to fix that before that 2-year statute of limitations. Generally, I don’t have cases where the statute of limitations is an issue.

With that said, where I do deal with it from time to time is when folks are trying to handle their injury claim themselves and they’ve been trying to collect their medical records, trying to get their car fixed, trying to get photographs to the insurance adjuster, and all of a sudden it’s been 18 19 20 months since their wreck. And they realize “I’m in this position now where the insurance company is delaying and dragging and get us closer to that 2-year time frame.” I do sometimes get involved with cases where someone is saying, “Hey I have four or five months left before the statute runs out, can you help?” and those are times where we’re dealing with cases where things can get close to the statute limitations. For those without a lawyer it can be very scary because the insurance company will drag it out and get it as close as possible to the deadline in the hopes that you would accept less money.
