Hey guys my name is Bailey Gifford. I’m the senior associate attorney here at Cooper Hurley Injury Lawyers and I wanted to tell you about one of the recent settlements that my team reached.

This was a settlement for a local Hampton Roads mom. She’s a nurse, she’s a Navy spouse, she was at one of our local Hampton Roads businesses when she tripped and fell and ended up getting a pretty nasty injury to her knee; got some permanent lingering symptoms and had a couple surgeries related to that injury. We were able to get involved in on the case pretty early on, she ended up finding us on the internet and we essentially took over all aspects of communicating with the business, their insurance company, doing an investigation, doing a site inspection, and really locking down the liability components of the case while also helping making sure that she got the medical treatment that she needed.

And that everything was progressing along with that, but that way, our client could really focus on feeling better, taking care of her family, and getting back up on her feet. We were able to reach a settlement just after the year mark without filing a lawsuit or going to court or any of that, and the settlement was $275,000 which was an excellent result in this case.

When you get hurt at someone’s business, it’s called a premise liability case if you’re hurt on someone else’s property, premises liability cases in Virginia can be a little difficult because of how our laws are. One of their most challenging laws is on contributory negligence. So under Virginia law, if the jury were to find you 1% at fault for causing your own injury, they’re told to give you nothing. It’s crazy we’re only, we’re one of the only states that still has that. But it’s a common defense, particularly in premises liability cases, and it’s a defense that was brought up her,e but we were able to successfully rebut that and reach this great settlement for our client.
