What Makes Brain Injury Cases Complex?

Video Transcript

Brain injuries can be incredibly complex, and what makes them so complex is in some ways, they can be an invisible injury. You can suffer a, a catastrophic brain injury or what in the medical field is often referred to as a mild traumatic brain injury. When you look at someone with a brain injury, it’s not always obvious. So, trying to tell that person’s story and trying to convey to a jury or an insurance company the true extent of what this person’s gone through can be a challenge when they look relatively healthy. The other complicated part of a brain injury case is that not all head injuries involve bleeding of the brain. There can be microscopic shearing of the brain tissue that can then result in very significant problems. Another obstacle with a brain injury case is the person who suffered the brain injury is often in denial about the fact they even have a brain injury themselves just by the nature of what they’re going through. In those cases, I’ll often want to talk to close family members and, and friends to see if they detected a difference or a change in, personality or attitude or just day-to-day activity.
