Virginia is a contributory negligence state. Virginia is one of the few states in the country left that use this type of negligence law, or contributory negligence law. It’s a very harsh law, well it’s a law that’s been around a long time, but it stands for the idea that if the injured person shares any fault at all in causing their own injury, they’re barred from any recovery. If you think about that, that’s a very harsh outcome, whereas if the at fault driver who injures you in an accident is 99% at fault, but you share mere 1% shared fault in causing the accident and your resulting injuries, then you’re barred from any recovery in Virginia.
