How does severe weather impact a car accident case?
Video Transcript
So severe weather is something that we regularly deal with in Hampton Roads. Right just this morning, I’m driving in, and Interstate 64 is completely shut down during the rainstorm because there’s vehicles blown all over the roadway. Severe weather generally cannot affect a decision on fault for a collision. The law says that that weather’s not an unexpected occurrence, right? We’re all out there, we all see it, we’re all experienced drivers and should be expected to know how to react and behave and be a responsible driver under those circumstances. With that said, it’s not uncommon for insurance companies to claim that the weather is really the cause for the wreck. So you do need an experienced personal injury lawyer to help you push back against those unfounded claims to make sure that if you’re rearended by someone else– that wasn’t the snow’s fault, that wasn’t the ice’s fault, that wasn’t the wet roadway’s fault, it was that at fault driver’s fault for either not respecting the conditions on the roadway, or for not leaving enough of a room to stop given what the roadway conditions were. So it’s something that we do have to deal with. Generally, it’s not something that should be an excuse to avoid liability for a wreck. [jingle] No need to worry, call Cooper Hurley.
