How Do You Prove Negligence in a Car Accident Case

There are many different ways to prove negligence in a car accident case. No two cases are the same, so the investigative approach is not going to always be the same with a personal injury case.
When you’re dealing with car accidents, oftentimes you do have the benefit or the head start of the police investigation. The police came to the scene, we can get the accident report. We can try to interview the police officer. Oftentimes these police officers now wear body cameras, and while they’re usually not there when the accident itself happens, while I’ve had that scenario, they arrive shortly thereafter. We can usually get our hands on the body cam footage, which often has very valuable evidence in it. There’s often conversations with the at-fault driver, statements made by the at-fault driver that don’t make their way into the accident reports, but we now have the audio of the defendant at the scene describing what happened. That police investigation gives us our head start, but we just don’t rely on that solely.
We have a great investigator we can send out to the scene if necessary, try to find witnesses, canvass the areas, see if a nearby business, maybe captured the accident on video. We’ll go to whatever length we need to find and preserve this evidence so that we can put on the best case possible and prove the truth, prove what really happened that day.
