Once a Case Is Resolved, What Is the Process for Receiving the Settlement?

Video Transcript

What happens after your case is settled? After your case is settled, we negotiate a fair number for you with your permission that we discuss and we make a recommendation and you tell us, “Yes, that’s fair. I’m happy with that. Let’s settle the case.” At that point, I will call the lawyer or the insurance company on the other side and let them know we have an agreement. We’re agreeable. We will accept the settlement offer. At that time, they will send us a document called a release. And the release will have sometimes it’s multiple pages, lots of fine print, but in essence, it’s a promise. It’s a contract that in exchange for this money, you will agree to drop your case forever and can never reopen it. So when we talk about whether or not to settle a case, I will be discussing with you that you’ve got to be at peace with this decision. You have to feel good about the decision because if you have second thoughts a year from now or later, I can’t undo it. So once you sign the release agreeing to drop the case forever, the settlement’s finalized. We send that back to the insurance company. They will send us the check, the settlement check for the amount. We put that in our client trust account. And then we will disperse that money to everyone owed money from the case, including yourself. And you’ll get an itemization showing you to the penny where every penny of that case went. So you know how much is going in your pocket, how much money was paid the doctors for outstanding medical bills if you have any. So that’s the basic process. After a case is officially settled, we sign the paperwork, we wait for the check, we deposit the check, and then we give you your money. No need to worry, Call Cooper Hurley.
