What Is the Process for Receiving Compensation From a Jury Verdict?

Video Transcript

What happens after you win your trial and a jury awards you money? If you have a jury trial or a trial with a judge and you win your case and you receive an award, a jury or judge will award you a sum of money. What happens next? First, sometimes the defense will approach you and try to settle the case with you after the verdict. They may argue they think they have grounds for appeal and they’ll try to leverage that in order to reach a settlement with you even though the jury already said what you are owed. Sometimes it’s a bluff. Sometimes they do it because they’re trying to keep a judgment off their client’s record. Sometimes they appeal it. They want to appeal it to the court above the court where the trial was. If they do that, that can tie up your money and your award from that judge or jury for a very long time. And there’s a deadline to note an appeal. So, if they don’t note that appeal within a certain period of time, then the judgment becomes enforceable. And ordinarily, there’s going to be an underlying insurance policy or insurance company behind the scenes that will pay that judgment for you. If they do not note an appeal, we will at some point from that insurance company, if there’s an insurance company involved, receive a check for the amount that the jury or judge awarded you.
