What Evidence Is Needed in a Virginia Premises Liability Case?

Video Transcript

Key pieces of evidence in a premises liability case are photos, witnesses, and prior instances. When you have a premises liability case, there’s a few things you want to make certain that you’ve got to get into evidence should it go to trial. Number one, you want to have photographs of the scene and the conditions that existed at the time of the incident, if possible. If it’s not possible, if you can get a photograph soon thereafter of similar conditions, that’s very helpful. You want to get any witness statements possible, either immediately following the incident or within a week or so of the incident while it’s still fresh in the witness’s minds. You also want to get their phone numbers and contact information in case it does have to go to trial. You’ll be able to get in touch with them later on down the road. Later on in your investigation of a premises liability incident, you want to try to find out if there were similar prior incidents that would have put the company on notice that there was a dangerous condition.
