How Does an Attorney Handle a Drunk Driving Case?

So when we hear that a drunk driver is involved and at fault for an accident, we have an entire set of procedures in our office. Because in Virginia, under certain circumstances punitive damage recovery is allowed for a drunk driver. We’re going to want to get a copy of the police report and see what the charges are. And if the driver is charged with a DUI or a related crime, we are going to send a court reporter to the traffic hearing, we are going to send a foyer request to the police department asking them to preserve any body cam footage or blood or breath alcohol tests so that we can use that evidence to obtain an award for punitive damages against the driver and the insurance company if the law permits. So there’s a lot of initial investigation that needs to be done when we hear that a drunk driver is involved because if you don’t gather that evidence, you might prevent the client from being able to recover for those punitive damages.
