Yes, you can file a personal injury claim if you’re injured as a passenger in a car accident, whether it be your own driver who was the at-fault person, or the other driver was at fault. And there have been situations where both drivers were at fault and you have to make a claim as a passenger against both drivers, your host driver, and the other driver. So an investigation’s important to try to figure out what happened, who was truly at fault in an accident, and there’s really no restriction on being a passenger and making a personal injury claim.

Many years ago, there were some restrictions on making a claim against your host driver, but those no longer exist in Virginia. We are mindful of the fact that oftentimes it is your host driver that caused an accident to a passenger. We’re mindful of the fact that, the fact that you’re in a car with that person often means you have a personal relationship with that person. So that can put someone in a, in a difficult spot of having serious personal injuries and medical bills that they need paid, but also having to make a claim against the insurance company for someone they know closely.
