Family of Pregnant Woman Killed By Tractor Trailer in Chesapeake is Awarded $3.4 Million
A wrongful death case in which a pregnant woman in a broken down car was hit by a tractor trailer on Interstate 664 in Chesapeake in 2012, has been settled for $3.4 million, according to media reports
The Virginian-Pilot reported the family of Crystal A. Burgsteiner from Newport News filed the death lawsuit against Christopher L. Johnson and Pennsylvania-based Vitran Express Inc. following the July 9, 2012, crash on I-664.
In my 25 years as a Chesapeake truck accident attorney, I have seen many dreadful crashes involving trucks. This was one of the most tragic I can recall in recent years in Hampton Roads.
Crystal Burgsteiner’s car had broken down and she was stopped on the I-664 shoulder with her flashers blinking when a tractor-trailer crashed into her and killed her.
The wrongful death lawsuit was brought on behalf of her husband and two boys, the Pilot reported. It alleged that the truck driver was speeding and driving recklessly and had a “long history of traffic convictions that included speeding and driving without a license” in Richmond and Portsmouth, VA.
As we explain in our new book The Best Book About Virginia Trucking Accidents, lawsuits in the event of trucking accidents can often be brought against a trucking company as well as the driver. Other parties such a shipping or loading company or the person leasing the truck may also be liable.
No amount of money can bring back a loved one lost due to the carelessness of a truck driver. I previously secured a $3.5 million settlement for a client who lost his father in a fiery truck crash on I-64 in Norfolk. All cases are different and we cannot guarantee the same result in your case, although we always fight the trucking companies to obtain the result you deserve. My congratulations go to the attorneys in the Burgsteiner wrongful death case, who were not named in the Pilot report.
