Cooper Hurley Client Receives $225,000 After Slipping on Waxed Floor
Companies, stores and cleaning contractors will often seek to minimize the seriousness of slip and fall accidents.
However, injuries from falls can be serious. This was illustrated in a recent case in which John Cooper of Cooper Hurley Injury Lawyers, secured a $225,000 settlement for a client.
The case, which was filed in Newport News Circuit Court, was featured in Virginia Lawyers Weekly on October 7, 2013. It was resolved about a month before trial.
It concerned a woman who fell at work when she crossed a floor that had been waxed by a janitor. The janitorial service was an outside contractor. John’s client said she had been waved through by the janitor, crossing the waxed area.
“Liability was hotly contested, as the janitor claimed that he told plaintiff not to proceed and was turning to find a way to dry and clear a path for here when she rushed through,” reported Virginia Lawyers Weekly.
There was some signage in the building but there was a dispute as to whether it was seen by the plaintiff.
She sustained serious injuries in the fall. She suffered an injury to her right shoulder, right hand, right hip neck and back.
“Ultimately the shoulder injury proved most troubling, resulting in a surgery to correct a full thickness tear of the rotator cuff,” stated the report in Virginia Lawyers Weekly.
The plaintiff had a large workers’ compensation lien which John Cooper was successful in getting waived in its entirety as part of negotiations.
