Spokeswoman Sgt. Michele Anaya said the accident occurred on October 6, 2012, on Old Stage Road in Brunswick County.
She said a 2003 Dodge Neon was traveling south bound, ran off the road to the right and hit a tree.
The driver and occupant were flown by nightingale to the Medical College of Virginia in Richmond. The 38-year-old driver later died at the hospital due to his injuries. The passenger, 39 from Warfield, VA, was reported to be in a critical but stable condition.
